How ESI eligibility actually works

ESI applies to employees earning Rs 21,000 or less in gross monthly wages (Rs 25,000 for employees with a disability), at establishments covered under the ESI Act (generally those with 10 or more employees, though this varies by state). Once you’re enrolled, a common misconception is that crossing the wage ceiling mid-year removes you from ESI immediately; in practice, ESI Regulations require continued coverage until the end of the current contribution period (April to September, or October to March) even if your salary rises above the ceiling during that period.

Is ESI the same as health insurance my employer might provide separately?

No. ESI is a statutory scheme run by the Employees’ State Insurance Corporation, covering medical care, sickness benefit, maternity benefit, and more, funded by the mandatory contributions shown above. A separate employer-provided health insurance policy (mediclaim) is a distinct, optional benefit and doesn’t replace your ESI eligibility if your wages qualify.

What happens to ESI contributions I’ve already made if I later stop being eligible?

Contributions already made fund the benefits you’re entitled to during your period of coverage; there’s no refund mechanism if you cross the wage ceiling and exit the scheme at the end of a contribution period.

Does ESI apply to contract or temporary workers?

Yes, if they’re on the payroll of a covered establishment and their wages fall within the ceiling, regardless of whether they’re permanent, temporary, or on a fixed-term contract.

Can I opt out of ESI if I’d rather have the money in-hand?

No, ESI is mandatory once you’re eligible; neither you nor your employer can opt out of contributions for an eligible employee.
